• Limit coverage for cost of Reasonable Emergency Measures that are required by contract to the greater of $3,000 or 1 percent of the Coverage A limit, unless the policyholder first receives approval from Citizens.
• Require prompt Loss Reporting by excluding coverage for permanent repairs that begin before the earlier of:
-72 hours after Citizens is notified of the loss
-The time of loss inspection by Citizens
-The time of other approval by Citizens
• Clarify that coverage does not apply for:
-collapse of plumbing caused by deterioration or age,
-access is provided only for the part or portion of the plumbing system that caused the covered loss
-insured must comply with duties after loss, there is no coverage if failure to comply prejudices Citizens.
Following those changes, at its September 2016 meeting, the Board also approved policy changes to support two new programs offered by Citizens. These programs provide
Emergency Water Removal Services and Managed Repair Contractor Network Program and are completely optional for the policyholder.
During 2017 Legislative Session, Citizens and the private insurers worked closely with The Office of Insurance Regulation to propose significant legislative changes to address the continuing problems specifically associated with assignment of benefits (AOB) abuse. Unfortunately, no legislative changes were made and the policy language changes made in 2016 have not addressed the claim costs associated with AOB and water losses. Citizens has experienced a significant underwriting loss for 2016 and it appears that the abuse and litigation in water and AOB will continue. While legislative action is ultimately necessary to curb AOB abuse, it is clear that further policy changes are also needed.

]]>As common as that sounds, she had just placed the insurance on the vehicle with a new insurer because her old policy was cancelled for non-payment. There was a five-day gap in coverage. (this is only relevant because it likely caused a higher premium to be charged). When this woman contacted her agent to get the new policy, she said she had asked for “full coverage”.
I have heard this term used so many times, it is frustrating for this fictional coverage being referenced. This is extremely vague because the minimum insurance required in Florida is 10,000 personal injury protection (PIP) and $10,000 property damage liability (PDL) as long as you have a valid Florida license plate.
Is this “full coverage”? I guess it could be interpreted that way for some people. Look closely at this coverage. Essentially you have a minimal amount of “no fault” or “PIP” coverage to pay a portion of medical costs or lost wages up to $ 10,000. If you have ever been to the Hospital emergency room and seen a bill, $10,000 is barely enough to cover an evaluation after an accident. Now, if the accident is your fault, you have 10,000 to cover damage ot the other vehicle. With the average new car now costing about $30,000, that minimal amount of coverage leaves you with a big problem if there is serious damage to that other vehicle.
This “full coverage” meets the minimum required coverage. Is this really “full coverage”? wait a minute…. where is the coverage that ensures that your car is fixed? Any coverage to cover your medical expenses for a serious injury above the “no fault” limit? These coverages are optional since the minimum requirement is so “minimal”.
If you took a loan to purchase your vehicle, you are normally required to carry higher limits and more coverages by the lender. Back to the woman caller I spoke with this morning. The full coverage she had asked for had met the minimum requirement but the agent was not aware that there was a lien holder on the car which would have signaled a need for more coverage. This Woman obviously did not read her new policy or at least she did not understand the coverages. As it turns out, the other driver’s vehicle has more than $10,000 damage (Exceeds her coverage) and there is no coverage to repair her own vehicle which still has a five-year loan she must repay. The new insurance with the very attractive cost quote just cost this woman tens of thousands of dollars. It is likely that the other driver’s insurer will try to subrogate against this woman. Also, her own lender will start asking questions about her vehicle repairs for which she has no coverage. Perhaps most importantly, if she injured the other driver or herself, there is no coverage at all beyond their own PIP coverage of $10,000.
By not reading her new policy or simply not understanding her coverage, she is now going to face a host of financial problems and possibly health issues for years to come.
Buying insurance is required to register and drive a car in Florida. Have you ever stopped to consider how many people on the road have minimal or no coverage at all? The numbers are staggering. Insurance should be purchasing a bit of peace of mind. In the event an accident happens, your insurer should be there to help you. The reality Is that you should seriously consider making sure you purchase sufficient coverage to protect yourself against those drivers with little or no coverage.
If your budget allows, try to purchase higher property damage limits as well as coverage for damage to your own car. You should also purchase bodily injury coverage to protect against claims from other drivers if you happen to hit them with your vehicle and hurt them.
MOST IMPORTANT COVERAGE IS UNINSURED/UNDERINSURED MOTORIST COVERAGE!!!! I cannot stress this enough. With the number of drivers with little or no coverage, make sure you buy insurance to cover YOU! This coverage will pay for your injuries in the event there isn’t sufficient insurance from the other driver. If you have multiple cars on your policy, try to get the coverages “Stacked” to provide even more coverage.
There is a huge difference between required coverage and what this woman thought was “full coverage”!

]]>Are motorcycle helmets comfortable? Not really! Do Motorcycle Helmets look great on everyone? No! Could a helmet save your life? Absolutely, a helmet could mean the difference between life and death in a crash! Barely a single day goes by that a motorcycle crash is reported in the news in Florida. I have witnessed an accident where a helmet probably could have saved a life.
I would like to share another story with all of you that illustrate my point. Earlier this year, I met up with friends and family of a Biker friend who had recently died to participate in a “memorial ride” to his favorite restaurant in Hernando County. We met in Tarpon Springs and the Tarpon Police department was kind enough to assist in temporarily blocking traffic while the procession all rode out together in formation. In the parking lot, all bikes had been staged in line to exit onto U.S. 19 to head North. Traffic was stopped and a few of the bikes in front took off. The next few bikes did the same. I pulled onto 19 and maybe rode 100 yards when I saw 2 bikes and three people lying in the traffic lanes of U.S. 19. I couldn’t believe what I was seeing! Everyone pulled onto the side of the road and ran out to check on those on the ground. I have had my own crash but I was frozen as I looked at those people in the road. One of the men got up and was certainly panicked. The only explanation that would make sense for two bikes going down was that they had somehow collided.
The front bike rider was lying motionless, the driver of the second bike was the man that got up, the female passenger of the second bike was lying face down in the road and not moving much. The police were already on scene as they were directing traffic and it seemed like only a matter of seconds before you could hear the sirens on the ambulances and fire trucks approaching. The first responders moved everyone back off the road and went to work trying to assess the two people on the ground. Within the hour, a helicopter was landing in the road and the rider of the front bike was loaded into the aircraft and taken to the trauma center. The woman was rushed to the local hospital and at some point the paramedics started examining the driver of the second bike. The next day I found out that the driver and passenger of the second bike had relatively minor injuries. The other rider was in a Coma and had suffered massive head trauma. The second day after the Crash, I got the news that the biker had died.
Could a helmet have saved his life? Nobody knows for sure, but it likely would have helped to minimize the injury! In Florida, helmets are not required if you carry certain insurance coverage.
I certainly understand and can appreciate the desire not to wear a helmet from a comfort standpoint as well as the fact that it somehow adds to the riding experience for some. However, I urge everyone to wear a properly rated, good quality helmet every time you twist the throttle. Oh, and by the way…. flip flops and shorts are not proper riding gear no matter what you may think about helmets!! Don’t be another statistic and local news story simply because you chose not to wear a helmet!

]]>It was just a few months ago in May of 2016, when I was joining a group of riders for a memorial ride for a friend who had recently died, when two of the motorcycles in the procession entered the road and started to accelerate. Apparently the two collided Within 100 yards. , I came across those two bikes lying in the road and two of the three riders were not moving. The female passenger had been thrown from the bike and was lying face down on the pavement. The single rider was also lying in the road and not moving. Within 48 hours, we were mourning the death of another biker friend who died from injuries sustained in that accident.
My accident occurred 3 years ago on U.S. 19 and marine Parkway in Pasco County. I was cut off by a young female driver and hit my brake in some gravel on the road and the next thing I knew I was sliding on my side down the center lane of U.S. 19. I was waiting for a car to hit me from behind as I sat in the road with a broken knee. I somehow picked up my bike and kicked the floorboard down then road home on my mangled bike with unknown injuries since I had to get to my kids.
Only someone who has been through this experience can truly appreciate this situation. As a motorcycle rider since I was a kid, this was my first serious road accident and hopefully my last. As an attorney handling injury claims, I have the perspective and understand motorcycle accidents and the resulting injuries since I have been through the traumatic experience.
